Terms and Conditions

This agreement governs your use of BeamZe, the “Software” provided by the BeamZe project, the “Vendor”. By requesting an access to become a user (the “User”) to the Software, you agree to these terms. If you do not agree, do not install or use the Software.

License Grant and Usage

• Vendor grants you a non-exclusive, non-transferable license to use the Software, subject to payment and compliance with this Agreement.
• License are bound to single users. Concurrent use by multiple users in the same company requires purchasing additional licenses. The “Pro” version allows working in the same domain and share files and models.
• Free academic licenses have no limitations and are granted to the staff and students, in the context of their academic duties. Registration needs to be made with their academic email.

Ownership and Restrictions

The User may not:

• Modify, reverse engineer, or decompile the Software.
• Distribute, lease, or sublicense the Software.
• Copy the Software, except as necessary for its intended use.
• Share your login credentials. Multi-factor authentication is anyway required for login

Data and Privacy

• The Software may collect data, including personal and system information, for license verification and support.
• By using the Software, you consent to this data collection and processing.

Limitation of Liability and Warranty

• The responsibility of the Vendor regarding the quality or accuracy of the results, calculations, analyses, or any other information provided by the software, is expressly excluded, absolutely and without any exception.
• The User acknowledges and agrees that the software is a decision-support tool and that the interpretation and use of the results obtained are the sole responsibility of the User.
• Consequently, the seller shall under no circumstances be liable for any direct, indirect, consequential, special, or incidental damages, including, but not limited to, loss of profits, business interruption, loss of data, or any other financial or commercial loss, resulting from the use or inability to use the software, or from reliance on the results provided by it, regardless of the legal theory invoked, including, but not limited to, contractual, tort, or other liability, even if the Vendor has been advised of the possibility of such damages.
• The Vendor’s liability is limited to correcting errors or refunding license fees. Errors in the software, found or reported at any time will be corrected as soon as possible and a new release of the software will be distributed to the User.
• You agree that you will not seek injunctive relief against the Vendor.

Term and Termination

• The license is valid for a 1-year period for all purchased licenses
• The Agreement immediately terminates if you violate its terms.
• This Agreement is governed by the Belgian law. Any dispute will be settled by the court of Liège.
• The Vendor is not liable for delays caused by force majeure.
• This Agreement is the complete agreement between you and the Vendor.
